  • You can sell it, gift it, or leave it to your kids, no strings attached.
  • Banks are comfortable lending against it, because there’s no expiry date hanging over the deal.
  • You just pay property tax to the Indore Municipal Corporation every year — no separate rent to any landowner.
  • Your name sits clean in the government land records.

However, freehold does not mean you can ignore local rules. Building permissions, land use, property tax, development regulations, and other legal requirements still apply.

What is leasehold property?

A leasehold property is a property that you have the right to use and occupy for a fixed period of time, but you do not own the land or building outright. The land and/or building is owned by another party called the freeholder (or landlord).

The lease may run for a long period, such as 30, 60, or 99 years. Because the period can be very long, buyers sometimes forget that it is still a lease.

Suppose a property was originally given on a 99-year lease in 1970. If you are buying it today, you are not getting a fresh 99 years. You need to check how many years are actually left on the original lease.

Why does the lease period matter?

The lease period is one of the first things to check when comparing freehold vs leasehold property. You can use the property only for the time remaining on the lease.

For example, if a flat was given on a 99-year lease and 30 years have already passed, only 69 years would be left when you buy it.

If you buy it now, there are only 69 years left on the lease. You are not getting another 99 years from the date of your purchase.

Therefore, when you purchase a leasehold property in Indore, it is advisable to obtain the original lease document and note down the start and expiry periods, along with other conditions.

Do not rely only on what the seller says.

Can leasehold property become freehold?

Well, sometimes, yes. Urban leasehold properties can be converted to freehold properties in some laws of Madhya Pradesh. It can be used for a broad range of residential plots  and commercial Plots including leasehold properties with a lease of 30 years or more but there are conditions to meet.

Conversion does not happen automatically. In most cases, the property owner has to apply to the relevant authority, prove that they are eligible, clear any dues, pay the conversion fees and complete the documentation and registration.

So, if you are buying a leasehold property, do not think that it can be automatically converted to freehold later.

The lease deed and the rules applicable to that particular property matter.

If a seller tells you, “It can easily be converted later,” ask for documents supporting that claim and verify the current requirements with the concerned authority.

Checklist for Indore property buyers

Whether you are buying a plot, apartment, or another type of property, do not make your decision based only on price and location.

Start with the ownership documents.

For a freehold property go through all the papers carefully. Check the title, sale deed, previous ownership records, applicable approvals, and whether there are any registered claims or disputes.

For leasehold property, go one step further.

Checklist for buying property:

  • Who originally granted the lease?
  • How many years are left?
  • Is the lease transferable?
  • Is an NOC required before resale?
  • Is any lease rent pending?
  • Are there restrictions on construction or use?
  • What happens when the lease ends?
  • Is conversion to freehold allowed?
  • Are there any outstanding dues or violations?

These questions become particularly important when you are considering an older property in established parts of Indore.

Which is better: freehold or leasehold?

If there are two competing property alternatives at a similar price level, the freehold option could be simpler to understand, finance, transfer, and sell.

Nevertheless, this does not mean that all leaseholds are poor investments.

A leasehold property with many years left on the lease, proper documentation, transfer conditions, and price adjusted for its form of tenure will make a great buy.

The key point is to know what you are buying.
